A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.

The situation originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to face alien smuggling allegations, he was detained in immigration detention.

In her decision, the court noted that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
