New Jersey's top prosecutor steps down after court disqualifies her appointment.
The ex-lawyer for the former president has left her position as New Jersey's top federal prosecutor. This follows a legal ruling that challenged her legal standing to hold the office.
Acceptance of Resignation
US Attorney General, Pam Bondi, accepted Habba's resignation on Monday. In a statement that the appeals court finding made it unworkable for Habba to lead the department effectively.
"Do not interpret adherence to the ruling as defeat," she wrote. "The effort will now stretch across the country."
Judicial Challenge
The departure comes a week after a federal appellate panel ruled that she had been serving in violation of the law as the top prosecutor. This ruling is expected to impact scores of legal proceedings in the Garden State.
The judicial panel ruled that a temporary posting that did not receive the advice and consent of the Senate breached the federal law governing appointments.
Ongoing Legal Battle
The Attorney General added that she will stay on at the justice department as a top consultant. She will pursue additional appeals of the ruling, with hopes of a reversal.
On a social media platform, Bondi contended that the judiciary "cannot be permitted to override the executive's selection of attorneys entrusted with carrying out the primary duty of the administration of prosecuting crime."
Accomplishments Cited
Bondi praised the prosecutor's work and noted that during her run, the state capital of Newark saw a one-fifth decrease in crime. She also stated that the Camden experienced its first summer in half a century with no murders.
Connection to Donald Trump
Habba, originally became part of the former president's legal defense in 2021. Subsequently, she defended the former president in his business records case in New York last year, which resulted in his guilty verdict on dozens of charges of falsifying business records.
Earlier, Habba took on the top New Jersey post, Trump had revealed he was naming her as his presidential counsellor during his second administration, describing her as a steadfast ally and a "tireless advocate for justice".
